Terms and conditions of sale

This is a translation for your convenience. If there is any difference, the Spanish version prevails.

1. Who we are

These terms govern purchases and services contracted with Graziele Oliveira da Silva, tax ID 16862869M, address Calle Alfredo Palma 22, 1.º B, 29603 Marbella (Málaga), España, trading as GC Future Design (“we”), through gcfuturedesign.com or by email. Contact: dropsales4@gmail.com.

2. Acceptance, language and copy of the contract

By placing an order or accepting a proposal you confirm that you have read and accept these terms. You must be an adult to buy or hire. The contract can be concluded in Spanish, English, Portuguese or French; if versions differ, the Spanish one prevails. We email you the confirmation of each order or the accepted proposal, which is kept on file and available to you.

Part A · Skills and prompt guides (digital content)

3. Products

Each product is a folder of digital content: a PDF guide and, depending on the product, the master prompt, a skill and the resources we used in one of our projects. Each product page describes what it includes. It does not include third-party accounts, subscriptions or credits (Claude, OpenAI, Higgsfield, Vercel or others), whose prices and terms are set by those providers.

4. Price and payment

Prices are in euros and include applicable VAT. Today orders are placed by email: the “Buy” button opens your email app with the order ready. We reply with an order summary, the final price and the available payment methods. The contract is concluded when we confirm the order and receive payment. We will never ask for your card details by email.

5. Delivery

We email you the folder without undue delay after payment is confirmed. Delivery is manual, not instant. If you don’t receive it, check your spam folder and write to us.

6. Right of withdrawal

As a consumer you generally have 14 calendar days to withdraw without giving a reason. For digital content not supplied on a physical medium, this right does not apply once delivery has begun, provided you have given your express consent beforehand and acknowledged that you lose it (art. 103.m of Spanish Royal Legislative Decree 1/2007, TRLGDCU). So, before sending the folder, we will ask you to confirm this by email. If you don’t confirm, we won’t send it until the 14 days have passed. If you withdraw in time, we refund you within 14 days at the latest using the same payment method. A model withdrawal form is at the end of these terms.

7. Legal guarantee

We are liable for any lack of conformity of the digital content for two years from delivery (arts. 114 et seq. TRLGDCU). If a file is faulty, incomplete or doesn’t match its description, you can ask us to fix or replace it and, if that isn’t possible, for a price reduction or a refund.

8. Licence

We grant you a non-exclusive, non-transferable licence to use the product in your business and in projects for your clients. You may not resell, share, publish or offer it as your own product, in whole or in part.

9. Results

AI tools change and their results vary. The materials explain the method we use in our demos, but your result will not be an exact copy and depends on the tools, versions and credits you use.

Part B · Websites, apps, demo installation, Meta Ads and maintenance

10. Quote and contract

Prices on the website are starting prices (“from”) and exclude VAT, which is added at the current rate. After a consultation, we send you a written proposal with the scope, price, timeline and payment terms. The contract exists once you accept the proposal in writing, and the proposal forms part of it. Anything not in the proposal is quoted separately.

11. Payment

Payment terms and methods are set out in each proposal.

12. Timeline and cooperation

The proposal’s timeline starts when we receive the agreed initial payment and the content we need (texts, photos, logos, access details). Delays in sending content or replies on your side extend the timeline by the same amount.

13. Right of withdrawal for services

If you contract at a distance as a consumer, you may withdraw within 14 calendar days of accepting the proposal. If you ask us to start before those 14 days end and then withdraw, you pay for the proportion of work done. You lose the right once the service has been fully performed with your prior consent (arts. 103.a and 108 TRLGDCU). If you contract as a business or professional, there is no right of withdrawal.

14. Your content

You guarantee that you hold the rights to the content you send us and authorise us to use it only for your project. You are liable to third parties if that is not the case.

15. Ownership of the website or app

Custom website or app: once fully paid, we assign to you the exploitation rights in the design and code made for you. We keep the rights in our tools, methods and reusable components, and we may show the project in our portfolio unless you ask us not to.

Demo installed on your domain: you receive a non-exclusive, indefinite licence to use the demo adapted to your business on the agreed domain. The base design remains ours and we may keep showing it, installing it for other clients and selling it as a skill.

16. Conformity and corrections

If what we deliver doesn’t match what was agreed in the proposal, we fix it at no cost. If you are a consumer, you also have the legal guarantee of conformity under the TRLGDCU. Changes not included in the proposal are quoted separately.

17. Meta Ads and maintenance

The price and scope of advertising management or maintenance are set in the proposal. You pay ad spend directly to the platform. We cannot guarantee specific sales, reach or ranking results, which also depend on the platforms and the market. How to cancel a monthly service is set out in the proposal.

18. Liability

We are not liable for failures or changes in third-party services (hosting, domains, AI platforms, Meta, app stores) or for damage arising from your use of the website or app. If you contract as a business or professional, our liability is limited to the amount paid for the service. Nothing here limits the rights the law grants to consumers.

Part C · General

19. Customer service and complaints

You can send any complaint to dropsales4@gmail.com. We will acknowledge it and reply as soon as possible and within one month at the latest. If you are not satisfied, you can contact the consumer services of your region or the consumer arbitration boards.

20. Governing law and jurisdiction

These terms are governed by Spanish law. If you are a consumer, you may bring a claim before the courts of your place of residence. In all other cases, the parties submit to the courts of Marbella.
